This paper looks at the legal position of 'de facto' refugees in Western Europe, noting the difficulties that arise when the recognition of refugee status is different for different countries. Thus a person who qualifies as a refugee in one country might not qualify as a refugee in another country, in which case this person may be regarded as a 'de facto' refugee. The paper considers the various legal instruments in Europe related to the definition of refugee status.
